The Fair Debt Collection Practices Act: How it protects you

If harassment from debt collectors is giving you sleepless nights and you do not know what to do, then before considering any debt solutions, you must first find out about the laws that protect you against these debt collectors. Many debt collectors get away with tricks and harassing consumers. This is because most consumers are not aware of the laws that dictate the ways in which a collector can or cannot deal with you, while collecting debt.

The Fair Debt Collection Practices Act commonly known as the FDCPA is a law that governs the actions of the debt collectors, while they are collecting personal loans from consumers. These personal loans or personal debts include auto loans, medical bills, home loans and credit card bills. The act actually protects you, the consumer, from the ill treatment of debt collectors.

Some ways in which the act protects you from unnecessary harassment is as follows.

1. The collector can’t call you at work: As per the law the collector is not supposed to call you at work. This is if your collector is aware that your employer approves or does not approve of these phone calls. However, if you are ok with receiving calls at work, then you can do so.

2. Cannot use unfair practices: Your collector can not use unfair practices such as lying or forgery, to get money out of you. It will be considered illegal. The collector cannot harass or oppress you. Concealing his identity on the phone is also not allowed. As soon as he makes the call, he must identify himself as a debt collector. Using abusive language is strictly prohibited as per the Fair Debt Collection Practices Act. Thus, this protects you from being ill treated at the hands of your collector. In case a collector misbehaves with you, you have the full legal right to sue him or her.

3. Cannot contact any other person for your debt: As per the law, your collector is not supposed to contact any third party when it comes to collecting your debt. He or she may contact another person, but only to get your address or your phone number. Collectors are usually prohibited from speaking to such third parties more than once. Thus, a collector cannot go around telling your colleagues or relatives how much debt you have in order to embarrass you. However, if you have an attorney then your debt collector may contact your attorney instead of you.
